Use it or lose it

I’m going to have to check if this is legal or not but I’ve been asked to automatically remove people’s vacation entitlements if they exceed a company cap of 18 months. That means if you don’t take vacation for 18 months and just allow it to accrue, once you hit the 19th month, you don’t accrue any more vacation time.

You lose it.

While I understand that management wants to keep its vacation liability low and should actively encourage folks to take their time, I’m not certain they have the legal right to just take an employees accrued vacation time away. In the past they’ve always paid it out – usually to senior management. The policy change was announced last fall but now it looks like they’re actually going to be actively implementing it instead of just using it as a stick to push staff into taking their time.
